It's quite interesting how to handle this. There is obviously nothing wrong done by the seller in this case prior to the banishment. The questions is however who the risk is to be laid on until the registration has changed (and the deal is 100% completed).
It's of my oppinion that the money exchanging hands is the critical point in this consideration. If I'm for example to pay someone when the character is in my registration, the seller probably got the risk for the character being banned during the change. If I on the contrary pay for the character and then wait for it to change registration, even though I might not play it due to the risk of being hacked back, its more likely that I as the buyer should be standing the risk for a banishment.
That being said, using a middle man would probably mean the payment being split unless anything else has been said in the deal. Regarding the middleman regulations I suggest anyone doing deals as middle-man to have some pre written rule for the trades, as it might in bigger trades be quite large amount of money being lost.
